San Diego Motorcycle Accident Lawyers

San Diego is known for having the best weather in the country, making it an ideal spot for all types of outdoor enthusiasts. With picturesque highways that stretch along the coast and beautiful winding mountain roads, it is no wonder that motorcyclists enjoy San Diego since it’s nearly always a great day for a ride.

Unfortunately, despite the beautiful terrain, riders are not protected from the potential hazards that come with riding a motorcycle. In San Diego County alone, according to statistics, there are over 19,000 victims killed or injured in car accidents alone every year, and national statistics show that motorcyclists are even more at risk, as they are three times as likely to get killed in a collision.  Some accidents are unavoidable. But many times, accidents are caused by careless, distracted, and otherwise negligent drivers.

Wilshire Law Firm specializes in assisting San Diego motorcycle accident victims. For over 11 years, we’ve been helping our clients navigate the legal system in order to maximize their settlements. If you or a loved one has been injured in a motorcycle accident as a result of another person’s negligence, we are here to help. Top Causes of Motorcycle Accidents in San Diego

There are many factors that contribute to motorcycle accidents. Motorcycles offer less protection to their riders than enclosed vehicles, and they are also less visible on the road.  Some motorcycle driver deaths involve just the motorcycle driver and no other vehicles (known as a single-vehicle crash). Generally, speed and alcohol contribute greatly to these types of accidents. In 2016, according to data from the Insurance Institute for Highway Safety, 43 percent of motorcyclists killed in single-vehicle crashes were speeding, and 37 percent had alcohol in their systems, with blood alcohol concentrations of 0.08 or more.  Rider inexperience, aggressive driving and distracted driving also contribute significantly to single-vehicle motorcycle accidents.

However, nearly two-thirds of motorcycle accidents involve another vehicle. According to a report on Traffic Fatalities by State from the Governors Highway Safety Association, car drivers are often at fault in crashes involving motorcycles. The most common collisions occur when an automobile driver makes a left turn and the motorcyclist is going straight, passing, or overtaking other cars. Because motorcycles are relatively small, they’re often not immediately detected by car drivers.  Accidents are also common when motorists get too close trying to pass, or when they fail to yield to motorcyclists at intersections.
Other commonly cited reasons for motorcycle accidents in San Diego include:

Distracted driving:

If a motorist is texting, arguing with a passenger, playing with the radio, or is otherwise not engaging their full attention on the road, accidents can happen. This is considered to be negligence.

Poor road conditions:

If a road isn’t well maintained, is slick, or is full of potholes, the road can be very dangerous to a motorcycle rider. Because motorcycles are two-wheel vehicles, they’re prone to more of a “wobble” effect on poorly maintained roads as compared to passenger cars and trucks.

Careless driving:

In California, “lane splitting” is legal, but many times motorists don’t properly check blind spots for motorcyclists, or they don’t properly yield to motorcycle drivers, causing collisions.

Common Motorcycle Accident Injuries

Motorcycles offer little protection for their riders – a rider’s arms and legs are exposed, and therefore in a collision, those extremities make an immediate impact with the road. Thus, broken bones (particularly arms, legs, fingers, and ribs) are fairly common in motorcycle accidents. Road rash is another highly common motorcycle-accident related injury. During a crash, the rider’s body makes direct contact with the road, which can cause serious skin burns and scrapes, sometimes leading to infections.
In the majority of accidents, riders are thrown from their bikes, making head injuries very common and the top cause of death for motorcyclists.  As such, concussions and head and brain injuries are also particularly common. Other significant traumatic injuries from motorcycle accidents include paralysis and disfigurement, which can result in life-long disabilities.

While injuries can’t always be avoided, motorcyclists can help protect themselves by purchasing and always wearing protective gear. Here is a list of gear recommended by the Department of Motor Vehicles.

Benefits of Pursuing a Motorcycle Injury Claim

Motorcycle accidents can be life-changing. They often involve significantly severe injuries that can keep you away from work for an extended period of time while you recover. If another party is found to be negligent in your collision, you may be able to receive compensation for your medical bills, any lost income, and even your pain and suffering.  It is particularly important that you contact an attorney shortly after your accident, so while you (or your loved one) is healing, your attorney can begin an investigation into your claim and start to collect evidence to support it.

Valuing a Motorcycle Accident Case

Compensatory Damages
If you are injured because of a motorist’s negligence, you may be entitled to compensatory damages. Compensatory damages are determined by several factors, including the severity of the injuries, and how much the other party is considered to be liable. Such damages are intended to make up for financial losses caused by the accident, such as damage to the motorcycle (property damage), medical bills, and lost current or future income.  This category of damages can also include compensation for any modifications to your home that need to be made as a result of the accident.

Non-Economic Compensatory Damages
This is compensation for intangible losses, like pain and suffering, or mental anguish. Non-economic compensatory damages can also include loss of consortium (accommodation for the absence of a companion and/or the income the victim was contributing) or emotional distress.

Punitive damages
In certain cases, you may also receive punitive damages – or damages meant to “punish” the other party if they were acting maliciously or in a fraudulent or reckless manner when the accident occurred.
